PROPERTY DAMAGE / PERSONAL INJURY REPORTING
The Claims Management Administrative Directive defines when and how employees must report property damage to Town of Marana assets (7.1 Property Damage), and when to report incidents of personal injury or personal property damage that occurs at a TOM facility or from a Town-sponsored activity or project (7.2 Damage to Personal Property/ Injury to Person). Which Incident Report Form Do I Use?
7.2 – DAMAGE TO PERSONAL PROPERTY / INJURY TO PERSON Incident Report*
If you are staff member that is working in the community on a Town project or activity, such as road maintenance, landscaping, or police enforcement, and you damage property owned a private citizen you must complete FORM 7.2 – DAMAGE TO PERSONAL PROPERTY / INJURY TO PERSON. If you are a staff member working in the community on a Town project or activity, which results in an injury to a person who is NOT an employee, you must complete FORM 7.2 – DAMAGE TO PERSONAL PROPERTY / INJURY TO PERSON. If you are a staff member working at a TOM facility that is open to the public, such as the MMC, MCC, or Pool, and a citizen is injured in your facility, you must complete FORM 7.2 – DAMAGE TO PERSONAL PROPERTY / INJURY TO PERSON.
Examples:
· Did I break/damage something that belongs to a private citizen during the course of my job? – Yes, then complete DAMAGE TO PERSONAL PROPERTY / INJURY TO PERSON form.
· Did I cause injury to a private citizen during the course of my job? – Yes, then complete DAMAGE TO PERSONAL PROPERTY / INJURY TO PERSON form.
· Did a private citizen injure himself or herself while using a TOM Facility or participating in a TOM sponsored activity? – Yes, then complete DAMAGE TO PERSONAL PROPERTY / INJURY TO PERSON form.
*For Damage to Personal Property / Injury to Person incident reports refer the injured party to the Town Clerk’s Office to file a Notice of Claim as a follow-up to the incident. Staff members should direct all inquiries regarding liability acceptance to the Town Clerk’s Office and Legal Department only.
7.1 – DAMAGE TO / LOSS OF TOWN PROPERTY Incident Report
If you are a staff member that damages TOM property, such as a vehicle or assigned piece of equipment, you must complete FORM 7.1 - DAMAGE TO / LOSS OF TOWN PROPERTY. If you are a staff member who discovers damaged or loss TOM property, such as a downed street sign or guardrail, you must complete FORM 7.1 - DAMAGE TO / LOSS OF TOWN PROPERTY.
Examples:
· Did I break it? – Yes, then complete DAMAGE TO/LOSS form.
· Did another employee break it? – Yes, then complete DAMAGE TO/ LOSS form.
· Did I discover it broken, but I don’t know who did it or when it happened? – Yes, then complete DAMAGE TO/ LOSS form.
· Did someone report it broken to me, and I am responsible for repairing it? – Yes, then complete DAMAGE TO/ LOSS form.
