The Marana Planning Commission will hold a public hearing on October 30, 2024 at or after 6:00 p.m. at the Marana Municipal Complex located at 11555 W. Civic Center Drive, Marana, Arizona, to consider amending the Marana Land Development Code.
The proposed amendments would add accessory dwelling units (ADUs) as a defined use in the Town’s zoning code and provide comprehensive regulations for ADUs in compliance with the newly-adopted provisions in Arizona Revised Statutes (A.R.S.) §9‑461.18. A.R.S. §9-461.18(F) provides that if a municipality fails to adopt development regulations for ADUs on or before January 1, 2025, ADUs shall be allowed on all lots or parcels zoned for residential use in the municipality without limits. While the population of the Town of Marana is less than 75,000 persons, the Town desires to adopt accessory dwelling unit regulations conforming to A.R.S. §9-461.18 that will automatically become effective when the population of the Town of Marana reaches 75,000 persons.
The proposed amendments would revise Marana Town Code (MTC) Chapter 17-6 “General and Miscellaneous Development Regulations” to add new section 17-6-14 (Accessory dwelling units) establishing development regulations for ADUs and make other corresponding changes to the MTC. New section 17-6-14 would provide that if the Town determines that adequate public utility services are available and the application complies with the Town’s building codes, fire codes, and public health and safety regulations, the following are permitted uses on any single-family lot or parcel that contains a primary dwelling: (1) one attached accessory dwelling unit and one detached accessory dwelling unit and (2) one additional detached accessory dwelling unit on a lot or parcel that is one acre or more in size if at least one accessory dwelling unit on the lot or parcel is a restricted-affordable dwelling unit. MTC section 17-6-14 would provide that ADUs are subject to specified development standards and regulations and exceptions as provided in A.R.S. §9-461.18. Section 17-6-14 would specify that it shall only become effective when the Town’s population reaches 75,000 persons.
