What does it mean if I invoke my victim rights? 

Our office will notify you of the defendant's upcoming court hearing dates. 

The defendant was sentenced or pled out, and I no longer received notice of upcoming court hearings; why? 

After a defendant has been sentenced or pled out, the victim must invoke their post-conviction rights. These rights are usually mailed right after sentencing or a plea has been taken. Please contact our office if you have not received the post-conviction package. 

I have stopped receiving notices from the Prosecutor’s office; why? 

Please ensure your contact and mailing information are always up-to-date with our office. 

I am a victim in the case; do I need an attorney?

How do I remove charges? 

As a victim you can give input to the prosecutor if you would like charges removed or dismissed.  Because the State has charged the Defendant with a crime , it is the prosecutor’s decision whether charges should be removed or dismissed.  If you would like to give input on the case, please contact the Prosecutor’s office.  

Do I have to attend the court hearings in which I am a victim? 

You are only mandated to attend a court hearing when you are subpoenaed. As the victim, you have the option to appear at the defendant’s court hearings, either in person or virtually. 

The Defendant is violating their Conditions of Release or Order of Protection; what do I do?

Our office cannot take statements. If you feel that the defendant is violating either, please make a police report. Call either 911 or the Marana Police Department non-emergency line: 520-382-2000.

I want to modify the Conditions of Release; what can I do? 

Please contact our office at 520-382-1900 to speak with the Prosecutor about making modifications. Please remember that the ultimate decision is up to the Judge.

How can I speak with the assigned Prosecutor of the case and provide input? 

Please contact our office at 520-382-1900 to arrange to speak with a Prosecutor. The victim’s input is taken into consideration, although the terms and sentencing recommendations agreed to under a negotiated plea are still ultimately the prosecutor's decision.

I fear for my safety; what can I do? 

Resources, such as EMERGE, can assist with safety planning for crime victims. You can also apply for an Order of Protection or Injunction Against Harassment through AZ Point. (Links are provided in our resources.)
